RULES OF THE CONTEST
1.ORGANIZING COMPANY AND PURPOSE
DANONE S.A., a company registered under the laws of France with the trade and companies register of Paris under the number 552 032 534 domiciled at 17, boulevard Haussmann - 75009 Paris (“Danone”) is the organizing company of a free game contest named “Danone Nations Club”, a digital version of the Danone Nations Club football tournament (the “Contest”), held from June 1, 2021 to November 15, 2022.
The Contest is accessible from the Danone Nations Cup Platform www.club.danonenationscup.com (the “Platform”).
This Contest is free of charge and without obligation to purchase and is open to any natural person between the ages of 10 and 15 years old by November 15, 2022 midnight GMT, having access to an internet connection and residing in one of the following countries: Metropolitan France and French overseas departments and regions and overseas collectivity (“DROM”/”COM”), Germany, Spain, Italy, England, Portugal, Romania, Bulgaria, Brazil, Argentina, Mexico, Uruguay, Algeria, Morocco, Egypt, South-Africa, Mauritius, Japan.
Employees and representatives of Danone, as well as members of their families and spouses (marriage, civil union or marital life whether recognized or not) and, in general, all companies that have participated in the organization, realization or implementation of this Contest, directly or indirectly, are however excluded.
Only one participation per person will be accepted throughout the duration of the Contest.
Any Participant must obtain prior permission from their parents or any other person having the parental authority to participate in the Contest and accept these Rules.
Danone reserves the right to request at any time to the holder(s) of parental authority for any Participant:
proof of his/her/their consent to the under legal age Participant receiving, where applicable, one of the Prizes.
The permission will be given by the Participant’s holder(s) of parental authority by means of a checkbox at the time of registration.
3.PARTICIPATION TO THE CONTEST
Entering the tournament entails the express and unreserved acceptance of all the clauses of these Rules.
Danone recommends that the Players undergo a full medical check-up by a healthcare professional before taking part in the challenges in the Tournament.
If the Player has any health problems likely to prevent them from making physical efforts (at the start of and during the Tournament), Danone recommends that the Player should not take part in the Tournament.
In addition, the Player should take all the suitable measures to choose a safe place to take part in the Tournament to avoid causing physical and/or material damage to themselves or others.
Danone will not be held liable for any physical and/or material damage suffered by the Player when taking part in the Tournament.
Players are not allowed to record or film images of third parties in their videos. Players are also forbidden from showing a brand or logo of a third party, conspicuously and/or for advertising purposes, on their clothes or any other supports that are visible in their videos.
The goal of the Tournament is to score as many points as possible by competing in the various challenges on offer on the Platform in order to be one of the 11 top Players (the “Top X1”).
The Top XI are:
The Player (one Player) who scores the most points of all the Players;
Then, the top five (5) boys (the five boys who score the most points in the category including all the boys) and the top five (5) girls (the five girls who score the most points of all the girls).
In the event of a tie between two or more Players, the number of “badges” won by each of the Players in the tie will be taken into account (these badges are awarded to Players according to their progress in the game and the scale of their interaction with the Platform) and the Player with the most badges will be selected amongst the Players in the tie. If there is still a tie, the youngest Player will be selected amongst the Players in the tie. The Top XI will be invited to attend a prize-giving Ceremony and a “Sports Camp” (the “Prize”) organised by Danone under the conditions laid down in Article 5 of the Rules.
The Tournament is divided into four levels, each one of which is made up of a number of challenges described below and is open until the end of the Tournament at midnight GMT on 30 September 2022. Levels 1 to 3 are accessible immediately after registering. A minimum of 36,425 points are required to access level 4.
When a Player correctly completes a challenge, they score a number of points according to the scale included in the appendix.
Players also score “bonus” points after confirming their registration on the Platform and after they have voted for the United Nations Goals that are the most important in their opinion.
Throughout the Tournament, Players score points that will also be counted by Danone as part of their support for three partner NGOs working to improve access to drinking water. The workings of this support and Danone’s commitments to this cause are described in Article 6 of the Rules.
The points will be counted according to the scale in the appendix by a Committee tasked with checking the proper application of the rules and made up of several people who work for Danone (the “Committee”). This Committee also manages, controls and moderates the registrations on the Platform, where necessary.
The criteria applying to each Player in the challenges that will be taken into account by the Committee when awarding the points, and/or the process regarding the points to be scored are described in detail in the scale in the appendix.
In accordance with the General Conditions of Use, the videos and/or photos published by each Player on the Platform when taking part in the Tournament will be made visible to the other Players by default. As an exception, Players can choose directly on the Platform to hide one or more of their videos/photos (given that, for the designs of the avatar patterns (level 2, Avatar design*), it will not be possible to ask for these designs not to be made public).
The accepted formats and lengths of the videos / photos are specified on the Platform for each challenge.

Level 1: Wonderkids
Challenge n°1: mini game category: “Shots”:
Players must score as many goals as possible in the time indicated on the Platform (online game). Players can multiply their points by scoring several goals in succession, without missing any shots,
Challenge n°2: freestyle category: “Pose like Lia Lewis”:
Players must publish a photo on the Platform, showing them in an original freestyle football pose.
Challenge n°3: football ambassador category:
“Ada: header juggling” Players must publish a video on the Platform showing them doing as many header juggles as possible in 15 seconds, just like Ada Hegerberg. A demonstration of this technical trick is available on the Platform.
“Lewen: do it like Lewen”: Players must publish a video on the Platform showing them doing the same technical trick as Lewen, the winner of season 1 of the Tournament, which consists of placing the ball on the goal line and curving the ball into the goal. A demonstration of this technical trick is available on the Platform.
“Javi: the backpack”: Players must publish a video on the Platform showing them do Javi’s technical trick that consists of flicking the ball backwards into an open backpack. A demonstration of this technical trick is available on the Platform.
Challenge n°4: game changer* category1: The champion’s meal:
Players must publish a photo of their pre-match meal that enables the youngsters to feel ready for some sport. Players will be rewarded for publishing the photo of their breakfast according to the scale in the appendix.
Level 2: Expert
Challenge n°1: mini game category: “Memory*2”:
Players must match the pictures of the footballers as children and as adults in 60 seconds (online game on the Platform).
Challenge n°2: Freestyle category: “Lia Lewis: doing the Slap”:
Players must publish a video on the Platform showing them performing Lia Lewis’ “Slap” technical trick. A demonstration of this technical trick is available on the Platform.
Challenge n°3: ambassador category:
“Ada: shoot at your problems”: Players must publish a video on the Platform, in which they do Ada’s trick, which consists of writing all the “problems” that each Player wants to solve on a board, then shooting the ball and hitting the board. The jury will take the creativity and the technical quality of the shot into consideration when awarding the points. A demonstration of this trick is available on the Platform.
“Lewen: tricks and shots”: Players must publish a video on the platform showing them doing Lewen’s trick, which consists of standing with their back to the goal, flicking up the ball, twisting around and volleying the ball into the back of the net. A demonstration of this trick is available on the Platform.
“Javi: the tennis ball challenge”: Players must publish a video on the Platform showing them doing Javi’s trick, which consists of doing as many juggles as possible with a tennis ball in 15 seconds. A demonstration of this technical trick is available on the Platform.
Challenge n°4: game changer* category3: Avatar design*4:
Danone will provide “patterns” of the shirt, shorts and socks that can be worn by the avatars chosen by each Player when they register for the Tournament. Every Player must download and personalise these patterns (designs), then publish their creations on the Platform. These creations will then be made available to the other Players to use them for their own avatars. Points will be awarded according to criteria that measure the creativity and the suitability of the design to the proposed medium (i.e., a design that can be reproduced in digital format and in a suitable form that can be used to clothe an avatar), and secondly, according to the use made of these creations by the other Players (whenever the pattern designs for shirts, shorts and socks proposed by each Player can be used by all the other Players for their own avatar).
Level 3: Legend5
Challenge n°1: mini game category: quiz:
Players must answer the ten questions displayed on the Platform as quickly as possible and within 150 seconds (online game).
Challenge n°2: freestyle category: “Lia Lewis: the Slap”:
Players must publish a video on the Platform showing them performing as many’ “Slaps” as possible in 15 seconds. A demonstration of this technical trick is available on the Platform.
Challenge n°3: ambassador category: “Do it like Ada II”:
“Ada: a legendary goal”: Players must publish a video on the Platform that shows them reproducing a “legendary goal” chosen by Ada Hegerberg. A demonstration of this technical trick is available on the Platform.
“Lewen: control and shoot”: Players must publish a video on the Platform showing them doing the same technical trick as Lewen, the winner of the 2021 DNC Tournament, which consists of inventing a creative ball control exercise, then shooting at goal. A demonstration of this technical trick is available on the Platform.
“Javi: the world tour challenge”: Players must publish a video on the Platform showing them performing as many “world tours” as possible in 15 seconds. A demonstration of this technical trick is available on the Platform. Challenge n°4: game changer category6: “Speak out”:
Players must answer the ten questions displayed on the Platform as quickly as possible and within 150 seconds to score points (online game).
Level 4: Ultimate*: only Players who have scored 36,425 points can access this level.
Challenge n°1: “Reverse challenge”:
“A reverse challenge for Ada”:
Players must publish a free-form video on the platform to challenge Ada to repeat their trick. Ada will repeat the tricks published by the first three Players who scored the most points for this challenge.
“A reverse challenge for Lewen”:
Players must publish a free-form video on the platform to challenge Lewen to do their trick. Lewen will repeat the tricks published by the first three Players who have scored the most points for this challenge.
“A reverse challenge for Javi”:
Players must publish a free-form video on the platform to challenge Javi to do their trick. Javi will repeat the tricks published by the first three Players who have scored the most points for this challenge.
“A reverse challenge for Lia Lewis”:
Players must publish a free-form video on the platform to challenge Lia to do their trick. Lia will repeat the tricks published by the first three Players who have scored the most points for this challenge.

4.SELECTION OF THE WINNERS
After the end of the Tournament, on 15 November 2022, the 11 Players who scored the most points (top girl or boy Player, then the top five boys and the top five girls) will be declared as the “Top XI” or “Winners”.
The Winners will receive an e-mail at the address(es) they provided when they registered, informing them of their selection within 15 calendar days of the end of the Tournament, and no later than midnight GMT on 30 November 2022.
In order to receive their invitations to the Sports Camp and the prize-giving Ceremony (the “Prizes”), the Winners must provide proof that they will be between 10 and 15 years old on 15 November 2022 (in other words, that they were born between 15 November 2012 and 16 November 2006). To do this, each Winner must send a copy of their ID card, or any other legal document that officially certifies their age, to Danone. In addition, Danone will check that each Winner and their Legal Guardians had accepted these Rules and the General Conditions of Use.
It is expressly agreed that, if a Winner fails to respond to the message informing them that they have been selected for the Top XI, and/or if the Winner does not prove that they are between 10 and 15 years old, within 10 (ten) calendar days after Danone sends the e-mail announcing their selection, it will be assumed that the Winner has irrevocably forfeited their Prize in full (including their attendance at the Sports Camp). In this case, Danone is free to offer the Prize to the next Player who scored the most points in all the categories, for the top Winner, or in the corresponding category for boys / girls, for the ten other Winners.
Once it has received this confirmation e-mail, Danone will inform the Winner that they have been added to the list of participants in the Sports Camp and the prize-giving Ceremony. The conditions applying to their participation are described in Article 5 of the Rules.
THE PRIZES: Sports Camp and prize-giving Ceremony
Each member of the Top XI wins a stay in a Sports Camp organised by Danone (the “Sports Camp”), which is scheduled for April 2023. A prize-giving Ceremony (the “Ceremony”) will be organised during the Sports Camp. The Sports Camp will take place in France or the United Kingdom, and will include football / sports practice sessions, various attractions and/or visits to an e-sports competition, etc. (this programme is subject to change). Danone will pay the costs of the transport and accommodation of each Winner and one accompanying adult, subject to the conditions given in Article 8.2.
Attending the Sports Camp is subject to the presence of the Winner’s Legal Guardian (at Danone’s expense, as per the conditions given in Article 8.2), who will take care of and supervise the Winner.
Danone reserves the right to organise the Sports Camp at another time in 2023 and/or at another venue in the European Union, provided that it informs the Winners of this change at least two (2) months before the date originally scheduled, and that it informs them of the new date of the event at least two (2) months in advance. In this case, Danone cannot be held liable, and the Players cannot claim any form of compensation whatsoever.
In addition, if the COVID-19 pandemic prevents the Sports Camp from taking place (e.g., due to restrictionsimposed by the government, such as lockdowns, curfews, bans on meetings, border closures, bans or restrictions on travel, etc. affecting all or part of the Top XI) during the above-mentioned period or on the dates confirmed by Danone in writing, Danone reserves the right to hold the event at a later date in 2023 or 2024 of its own choosing, provided that every Winner is informed of this change as soon as is reasonably possible, and that Danone informs them of the new date of the event at least two (2) months in advance. If it is unreasonable to organise the Sports Camp in 2023 or 2024, due to a case of force majeure or the COVID-19 pandemic, Danone cannot be held liable, and no compensation will be due (including financial compensation).
If the health situation so requires, Danone reserves the right to hold the Ceremony online in a 100% digital format. In this case, the Winners will receive a kit containing a trophy and the official DNC shirt and ball (the “Kit”), signed by Ada Hegerberg, the ambassador of the DNC. In this case, Danone cannot be held liable, and the Players cannot claim any form of compensation whatsoever.
Moreover, Danone cannot be held liable in the following cases:
the identity and/or address of the Winner is inaccurate or incomplete,
the Winner does not collect the parcel containing the kit before the deadline given by the postal services or the delivery company,
the Kit is damaged by the postal services or the delivery company.
In these cases, no compensation or indemnity of any kind whatsoever will be due, and the Kit will not be resent (a and b) or replaced (c). In addition, Danone will not put the Prize(s) on offer again.
Moreover, Danone will not be held liable if a Winner is unable to attend the Sports Camp and/or the Ceremony for any reason whatsoever, including any health-related restrictions that are in force in their country of residence, and, in this case, will be free to offer the Kit to another Player (but will send the Kit to the Winner who is unable to attend).
6. DANONE’S COMMITMENTS TO ACCESS TO WATER
Danone has agreed to pay a total sum of [€76,000] to three “social” companies supported by the Danone Communities investment fund, irrespective of the number of Players who take part in the Tournament.
This money will be used to improve access to drinking water for about 30,000 children, through their schools, thanks to the measures taken by these three “social” companies:
Naandi: supply of bottles of water to schools through the Naandi kiosks,
Oshun: installation of an Oshun machine (a water treatment system) in the targeted schools,
Nazava: installation of water filters in certain school classes in Indonesia.
The measures financed by the funds provided by Danone will be taken in 2022/2023, depending on the availability and the programmes of these partner social companies.
7. DANONE’S RESPONSIBILITIES
7.1 Interruption or modification of the Tournament
Danone cannot be held liable if it is necessary to interrupt, modify, postpone or cancel this Tournament for any reason whatsoever (in particular due to computer fraud, viruses, fire, floods, strikes or any other reason, cases of force majeure, COVID-19). If the circumstances so require, Danone reserves the right to extend, interrupt, modify or cancel the Tournament, without this decision entitling the Players to make any claims whatsoever.
Any changes to these Rules are likely to be subject to an amendment and/or information being sent to the Players.
7.2 Expulsion of Players
Danone reserves the right to proceed with all the necessary checks regarding the identity and the country of residence of the Players. Any Players who make a false declaration will be expelled from the Tournament automatically.
In addition, Danone will be entitled to punish any proven intention to commit fraud or any proven attempts to cheat by a Player, in particular by creating false identities or using computerised robots, by formally and definitively forbidding the Player from taking part in the Tournament, without any prior notice.
In the event of fraud, the Winner will be excluded from the list of the Top XI and will not receive their Prize (their invitation to the Sports Camp and the prize-giving Ceremony will be withdrawn).
Danone also reserves the right to take legal action in the event of fraud or attempted fraud, as per the provisions of Article 313-1 of the French Penal Code.
8 . REIMBURSEMENT OF COSTS
8.1 Reimbursement of the costs of taking part in the Tournament
Danone agrees to reimburse the costs incurred by connecting to the Platform in order to take part in the Tournament to all Players.
The reimbursement is a fixed amount of € 0.36 per request, including VAT. This amount corresponds to an estimate of the duration of the connection when taking part in the Tournament.
The Winners will receive a fixed reimbursement of € 0.72, including VAT, which is the estimated cost of the connection during the Tournament and the time required to send the confirmation e-mail mentioned in Article 4 of the Rules.
For Players living outside the euro zone, the reimbursement will be converted into the local currency at the exchange rate certified by the European Central Bank on the date of the reimbursement.
Requests for the reimbursement of the cost of taking part in the Tournament will be limited to one request per household (same name and same postal address) during the entire duration of the Tournament.
The request for reimbursement must:
be made in writing, duly franked and sent to Danone Nations Cup, DANONE S.A., 17, boulevard Haussmann - 75009 Paris, France, or sent by e-mail to:
state the name, first name and postal address of the Player;
state the date, time and duration of the connection to the site;
include a copy of the detailed bill of the telephone operator or the Internet access provider to which the Player is subscribed (excepting cases in which the access provider refuses to provide a detailed bill), on which the date and time of the connection to the Platform are clearly underlined;
include an IBAN/BIC code;
be sent to Danone within 10 days of receiving the detailed bill of the telephone operator and/or the access provider (the date of the bill and the stamp of the postal service will be binding).
The franking costs incurred by sending the request will be reimbursed by Danone, amounting to the current price for a 20-gram second-class letter, in response to a separate request attached to the request for the reimbursement of the connection costs.
The cost of photocopying the evidential documents will be reimbursed at the rate of € 0.15 per page, in response to a request attached to the request for the reimbursement of the connection costs.
Reimbursements will be paid by bank transfer within 60 days of receiving the request, after checking that the request is valid. In particular, the information in the letter requesting the reimbursement must match the information in the online registration form.
Requests for reimbursement that are illegible, incomplete, insufficiently franked or sent after the deadline has expired will be ignored.
In view of the current state of the technology, certain Internet access providers propose free or lump sum connections. It is expressly agreed that any access to the Platform www.danonenationscup/leclub.com that is made free of charge or as part of a lump sum offer (in particular by optical fibre, cable, ADSL or over a dedicated connection) will not be reimbursed, inasmuch as the subscription to the access provider’s services enables the Player to make general use of the network and that connecting to the Platform and taking part in the Tournament do not incur any additional costs or expenses.
8.2 Reimbursement of the Winner’s expenses incurred by attending the Sports Camp and the prize-giving Ceremony
Danone will pay the expenses incurred by taking part in the Sports Camp and attending the prize-giving Ceremony of the Winners only (and of the person accompanying them, who must be one of their Legal Guardians), i.e.:
the return flights from their country of residence to the venue of the Sports Camp (EU or UK),
a maximum of three nights’ accommodation,
transfers between the place of residence to the airport and transfers to the venue of the Sports Camp, when they concern the activities organised by Danone,
full board (breakfast, lunch and dinner, only during the Sports Camp and the Ceremony).
Danone will pay these expenses directly, but only to the service providers that it has selected (airlines, caterers, hotels, transport operators, etc.). No personal expenses will be reimbursed.
9. INVALIDITY OF A CONTRACTUAL CONDITION
The invalidation, in part or in full, of one of the conditions of these Rules, or its inapplicability, for any reason whatsoever, will have no impact on the validity of the other conditions.
10. ACCESS TO THE TOURNAMENT RULES
The full text of these Rules is available at https://www.club.danonenationscup.com/, which is openly accessible online. It is up to each Player to save and keep a copy of these Rules.
No questions raised in writing, verbally or by telephone about the Tournament or the interpretation and application of these Rules will be taken into consideration.
All disputes pertaining to this Tournament must be sent in writing only, in English, French or the official language of the Player’s country of residence, to the following postal address: Danone Nations Cup, DANONE S.A., 17, boulevard Haussmann - 75009 Paris, France, or to the following e-mail address: firstname.lastname@example.org.
These Rules are subject to the laws in force in the Player’s country of residence. All claims and all disputes (contractual or otherwise) resulting from these Rules or their purpose, or pertaining to them, will be referred to the competent French jurisdiction, unless the laws in force in the Player’s country of residence forbid this.
